By accessing or using Neon Lists ("the App", "the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

These Terms constitute a legally binding agreement between you and Neon Lists. Your continued use of the Service signifies your acceptance of these Terms and any future modifications.

2. Description of Service

Neon Lists is a free, web-based progressive web application (PWA) that provides shopping list management functionality. The Service allows you to:

• Create and manage unlimited shopping lists
• Add, edit, and delete items within your lists
• Share lists with other users for real-time collaboration
• Access lists offline through browser caching
• Sync data automatically across multiple devices
• Save barcodes for quick item entry
• Customize themes and personalize your experience

3. User Accounts and Registration

3.1 Account Creation

To use Neon Lists, you must sign in with a valid Google account. By creating an account, you represent that:

• You are at least 13 years of age
• All information you provide is accurate and current
• You will maintain the accuracy of your information

3.2 Account Security

You are responsible for:

• Maintaining the confidentiality of your Google account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access or security breach

4. Acceptable Use Policy

When using Neon Lists, you agree to the following acceptable use guidelines:

4.1 You May

• Use the Service for personal, non-commercial purposes
• Share lists with friends, family, and collaborators
• Create as many lists as you need
• Use the Service across multiple devices

4.2 You May NOT

• Use the Service for any illegal, harmful, or fraudulent purposes
• Share offensive, abusive, hateful, or inappropriate content
• Attempt to hack, reverse engineer, or compromise the Service
• Use automated systems (bots, scrapers) without authorization
• Impersonate others or misrepresent your identity
• Spam or send unsolicited invitations
• Upload malicious code, viruses, or harmful software
• Violate any applicable laws, regulations, or third-party rights
• Overload or disrupt the Service infrastructure
• Collect or harvest user data without consent

5. User Content and Intellectual Property

5.1 Your Content

You retain full ownership of all content you create, including:

• Shopping list names and descriptions
• List items and notes
• Any other data you input into the Service

5.2 License to Use

By using the Service, you grant us a limited license to:

• Store and process your content to provide the Service
• Display your content to collaborators you've invited
• Create backups for data recovery purposes

This license terminates when you delete your content or account.

5.3 Our Intellectual Property

Neon Lists, including its design, features, code, logos, and branding, is protected by intellectual property rights. You may not:

• Copy, modify, or distribute the Service code
• Use our branding or logos without permission
• Create derivative works based on the Service

6. Shared Lists and Collaboration

When you share a list with other users:

6.1 Collaborator Access

• All collaborators can view, add, edit, and delete items on shared lists
• Collaborators can see the names and profile pictures of other collaborators
• Changes are synced in real-time to all users

6.2 List Ownership

• The list creator (owner) can remove collaborators at any time
• Only the owner can permanently delete a shared list
• Collaborators can leave a shared list at any time

6.3 Your Responsibility

• Only share lists with people you trust
• Do not share sensitive or confidential information in list names or items
• You are responsible for managing your list collaborators

7. Service Availability and Modifications

7.1 Availability

We strive to maintain 99.9% uptime, but the Service may be temporarily unavailable due to:

• Scheduled maintenance and updates
• Technical difficulties or server issues
• Third-party service disruptions (e.g., Firebase, Google)
• Events beyond our reasonable control (force majeure)

7.2 Service Modifications

We reserve the right to:

• Modify, update, or discontinue features at any time
• Add new features or functionality
• Change the Service interface or design
• Implement usage limits or restrictions

We will make reasonable efforts to notify users of significant changes.

8. Free Service and No Warranty

We do not guarantee that:

• The Service will be uninterrupted, secure, or error-free
• Data will always be accurate, complete, or up-to-date
• Defects or bugs will be corrected
• The Service will meet your specific requirements
• Data backups will always be successful

9. Limitation of Liability

To the maximum extent permitted by law, Neon Lists and its developers shall NOT be liable for any damages arising from:

• Your use or inability to use the Service
• Loss of data, lists, or content
• Service downtime or interruptions
• Unauthorized access to your data
• Errors, bugs, or technical issues
• Actions of third parties or other users
• Any other matters related to the Service

10. Data Backup and Loss

While we implement backup systems to protect your data:

• We are not responsible for data loss due to technical failures
• You should maintain your own backups of important information
• Data recovery is not guaranteed in all circumstances

11. Termination

11.1 By You

You may stop using the Service at any time. To delete your account:

• Contact us at neoneasylist@gmail.com with your request
• We will delete your account and data within 30 days
• Alternatively, revoke access through your Google account settings

11.2 By Us

We may suspend or terminate your access if:

• You violate these Terms
• Your account is inactive for an extended period (2+ years)
• We believe your account poses a security risk
• We discontinue the Service

We will make reasonable efforts to notify you before termination, except in cases of severe violations.

12. Indemnification

You agree to indemnify and hold harmless Neon Lists from any claims, damages, or expenses arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Content you create or share

13. Changes to These Terms

We reserve the right to modify these Terms at any time. When changes are made:

• The "Last updated" date will be revised
• Significant changes will be announced within the app
• Continued use after changes constitutes acceptance
• If you do not agree to the new Terms, you must stop using the Service

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.

Any disputes arising from these Terms or the Service shall be resolved through good-faith negotiation. If negotiation fails, disputes will be subject to the exclusive jurisdiction of the appropriate courts.
